New rule gives Chapter 13 Debtors credit toward student loan forgiveness

New rules become effective July 1, 2024, and are separate from the December 2022 Department of Justice guidance providing a new avenue for student loan discharge in Chapter 7 and Chapter 13.  The new rules provide new benefits only to those in Chapter 13 bankruptcy cases.

Timing of Fee Applications

Attorneys should be filing fee applications as soon as the case is confirmed. If the Confirmation Order requires a fee application be filed and the Trustee does not see that this has been done, a reminder email will be sent indicating a two (2) week deadline to file the required fee application. If a fee application is not timely filed, the Trustee will release funds being held for the attorney so disbursements to other Creditors can begin.   Additionally, please remember to include the appropriate Bankrutpcy Code Section or Rule in the fee application.
